What is a suspended sentence?

A ‘suspended’ sentence is carried out in the community. Certain conditions must be met, such as staying away from a certain place or person and/or doing unpaid, community work.

If any of the conditions of the sentence are breached or a further offence is committed the offender will be sent to prison.

The judiciary have discretion to impose a suspended sentence rather than a custodial sentence for any offence where the sentence is for two years or less.

Offenders serving suspended custodial sentences have a lower re-offending rate than offenders serving short custodial sentences.
